The following is a summary of
Pennsylvania's regulations as they pertain to the inflatable
industry along with links to the actual regulations. There may be city
or county regulations as well, check with your local government entity. State
contact information is listed at the bottom of the page. |
Inflatable Variance
(pp 13-16) |
this variance allows a business
that rents an inflatable ride for a birthday party, picnic or similar
non-public non-profit event to inspect the inflatable ride on a monthly
basis, file an inspection report with the state and be exempted from the
requirements it inspect the inflatable ride at each new location and provide
an itinerary with respect to the rental.
verify that the persons to whom the inflatable ride will be rented or
donated will be provided a written set of instructions for the safe erection
and operation of the inflatable ride and provide the state a copy of these
written instructions.
(1)exempt such an inflatable ride from the requirement it be inspected on a
monthly basis or before its operation at each new location.
(2)exempt such an inflatable ride from itinerary requirements.
(3)comply with the requirements of the Act and its attendant regulations
when doing public events |
§ 139.4. Registration. |
An owner intending to operate or use an amusement ride shall register with
the state prior to operation.

§ 139.5. Insurance. |
A person may not operate an amusement ride or attraction unless a policy of
insurance has been purchased through an authorized carrier in the amount
of at least $ 100,000 per occurrence and $ 300,000 in the aggregate for inflatables.
A
valid certificate of insurance filed with the state prior to
operation for use by the public. |
§ 139.6. Itinerary. |
The owner of an amusement ride shall file an itinerary at least 15 days prior
to the operation of a ride use by the public |
§ 139.7. Inspection. |
owner will have rides inspected by a qualified inspector
(1) prior to
operating for the first time
(2) every 30 days
(3) prior to operating
at a public event |
§ 139.8. Inspection affidavits. |
owner will file an affidavit of inspection written by an authorized inspector
within 48 hours of the inspection
The owner shall post a notice of
compliance at a place readily observed consisting of a sign made of substantial
and, if exposed to the elements, of weatherproof material with bright green
background and white lettering. The size of the letters may not be less than 1/2
inch in height and 1/8 inch width stroke reading THIS RIDE HAS BEEN INSPECTED AS REQUIRED BY THE PENNSYLVANIA AMUSEMENT RIDE
INSPECTION ACT. |
§ 139.11. Accident reporting. |
(a) When an owner submits an accident report to the owner’s insurance
company, a copy of those reports shall be sent to the state
(b) When
a serious injury, death or fire occurs the operators shall immediately close
the ride and the owner shall so notify the state |
§ 139.41. General. |
(a) Manufacturers shall design and construct the amusement ridesto carry
all loads safely and to withstand normal stresses
(b) Manufacturers
shall comply with ASTM Standards
(c) Owners of existing amusement
rides are responsible for obtaining the required construction maintenance and
operational information from the manufacturer |
§ 139.71. General requirement. |
(a) Owners and operators of amusement rides shall use ASTM Standards |
§ 139.77. Maintenance of amusement rides and attractions. |
(a) The owner shall implement a program of maintenance, testing and
inspection, based on manufacturer’s recommendations
(b) Manufacturers’
identification information shall be maintained in a readily visible and legible
condition at all times |
§ 139.79. Records. |
(a) The owner shall maintain the following records
(1) Daily
inspection records
(2) Tests recommended by the manufacturer |
